Legal Matters

Attorney-Client Privilege

When you engage our registered advocates for legal representation or legal advice, all communications are automatically protected by attorney-client privilege under:

  • The Advocates Act, 1961 (Section 24)
  • The Indian Evidence Act, 1872 (Section 126)
  • Bar Council of India Rules (Professional Ethics)

What this means for you:

Your advocate cannot be compelled to disclose your communications in court or to any authority. This privilege survives termination of the engagement and continues after death.

Consulting Matters

NDA + Consulting Agreement

For advisory and consulting mandates, we execute a comprehensive Mutual Non-Disclosure Agreement and a Consulting Engagement Letter before any sensitive information is shared.

  • Mutual NDA — protects both parties
  • Consulting Agreement — defines scope, fees, IP
  • Data protection under DPDP Act 2023

What this means for you:

All information you share is contractually protected. Any breach entitles you to injunctive relief and damages. Documents are not shared internally without your written consent.

Confidentiality Questions

Do I need to sign an NDA before our first call? +
No. The initial discussion call (30 minutes) is free and without obligation, and no confidential information needs to be shared at that stage. We sign the NDA before the detailed engagement scoping session where sensitive information is discussed.
What is the difference between attorney-client privilege and an NDA? +
Attorney-client privilege is a legal right that arises automatically when you engage a registered advocate for legal advice or representation. It is absolute and cannot be waived without your consent. An NDA is a contract — it provides strong protection but is governed by contract law. For legal matters, privilege applies; for consulting matters, the NDA governs.
Can my consulting engagement transition to legal representation? +
Yes. If during a consulting engagement it becomes apparent that legal representation is needed, you can engage our registered advocates. A separate retainer agreement is then executed and attorney-client privilege applies to all legal communications from that point.
Under what law is the NDA governed? +
Our standard NDA is governed by Indian law, with jurisdiction in the courts of New Delhi. For international clients, we can negotiate an alternate governing law and jurisdiction if required.
Is my information shared within KC Jurist Chambers? +
Information shared under the NDA is shared only with team members directly working on your mandate and bound by the same confidentiality obligations. We maintain information barriers between legal and consulting teams where required by conflict of interest protocols.
What happens to my documents after the engagement ends? +
All confidential documents are retained for 7 years in our secure document management system and then securely destroyed. You may request destruction at any time. Digital copies in the client portal are deleted upon request.
